§ 1 Information About the Collection of Personal Data

(1) The following provides information about the collection of personal data when using our website. Data that make you uniquely identifiable, e.g. name, address, e-mail addresses, user behaviour, are considered personal data.

(3) When contacting us by e-mail or via a contact form, we save the information that you provide (your e-mail address and possibly your name and telephone number) in order to respond to your inquiry. Data collected in the course of this will be deleted after its storage is no longer required, or we may limit the processing of which if statutory retention obligations exist. By sending us your request, you give us your consent to data processing in accordance with Art. 6 (1) letter (a) GDRP.

(4) If we make use of contracted service providers for individual functions of our offer or if we intend to use your data for advertising purposes, we will inform you in detail about the respective processes below. We also communicate the defined criteria for the storage period.

§ 2 Your Rights

(1) You have the following rights with regard to personal data concerning you:
–     Right to information,
–     Right to rectification or deletion,
–     Right to restriction of processing,
–     Right to object to the processing,
–     Right to data portability.

(2) You also have the right to complain to a data protection supervisory authority about our processing of your personal data.

§ 3 Collection of Personal Data when Visiting our Website

(1) When you use our website for information purposes only, i.e. if you do not register or otherwise provide us with information, we only collect the personal data that your browser transmits to our server. When you view our website, we collect the following data, which are required for technical reasons in order to display our website to you and to guarantee stability and security (legal basis is Art. 6 para. 1 sentence 1 letter f GDPR):

– Date and time of the request
– Time zone difference to Greenwich Mean Time (GMT)
– Content of the request (actual page)
– Access status / HTTP status code
– Volume of transmitted data
– Website from which the request originates

– Operating system and its interface
– Language and version of the browser software.

(2) In addition to the aforementioned data, cookies are stored on your computer when you use our website. Cookies are small text files that are stored on the hard disk designated by your browser and through which certain information is sent to the server that places the cookie (in this case us). Cookies cannot execute programs or transmit viruses to your computer. Their purpose is to make the website more user-friendly and effective overall.

b) Transient cookies are automatically deleted when you close your browser. In particular, these include session cookies. f) The flash cookies used are not stored by your browser, but instead by your flash plug-in. We also use HTML5 storage objects that are stored on your terminal. These objects store the required data regardless of the browser you use and do not have an automatic expiry date. (1) In addition to the informational nature of our website, we offer various services that you may use if interested. This may require you to provide additional personal data, which we use to render the relevant services to you and to which the aforementioned data processing principles apply.

(2) We may at times use external service providers to process your data. These have been carefully selected and commissioned by us, are bound by our instructions, and are regularly inspected.

(3) Furthermore, we may disclose your personal data to third parties in the event of contracts or similar services that are offered by us in cooperation with partners. Further information is available upon providing your personal data or in the footnote in the description of the offer.

(4) If our service providers or partners are based in a country outside the European Economic Area (EEA), we will provide information on the ramifications of this in the description of the offer.

§ 5 Objection or Revocation against the Processing of Your Data

(1) If you have given your consent to the processing of your data, you can revoke this at any time. Such a revocation impacts the permissibility of processing your personal data after you have issued it to us.

(2) If we base the processing of your personal data on the weighing of interests, you may object to the processing. This is the case particularly if processing is not necessary to fulfil a contract with you, which we describe in each case in the subsequent description of the functions. When raising such an objection, we ask you to please provide a reason as to why we should not process your personal data as done previously. In the event of your justified objection, we will examine the situation and either stop or adjust data processing or point out to you our compelling reasons worthy of protection, on the basis of which we will continue processing.

(3) You may object to the processing of your personal data for the purpose of advertising and data analysis at any time. You can inform us about your objection to advertising under the following contact information: datenschutz@elobau.de.


§ 6 Newsletter

(1) You may opt to subscribe to our newsletter, with which we inform you about our current, interesting offerings. The advertised goods and services are listed in the declaration of consent.

(2) We use the so-called double-opt-in process when you subscribe to our newsletter. This means that, after your registration, we will send an e-mail to the e-mail address provided, in which you are required to confirm your subscription to the newsletter. If you fail to confirm your registration within 30 days, your information will be blocked and automatically deleted. Furthermore, we store your IP addresses and times of registration and confirmation. The purpose of this process is to provide proof of your registration and investigate any possibly misuse of your personal data.

(3) Only your e-mail address is required to subscribe to the newsletter. Providing additional, separately marked data is voluntary. This information is used to address you personally. After your confirmation, we will store your e-mail address in order to send you the newsletter. The legal basis is Art. 6 (1) para. 1 letter (a) GDPR.

(4) You can revoke your consent to receive the newsletter at any time and unsubscribe from the newsletter. You can cancel your subscription by clicking on the link provided in every Newsletter e-mail, by sending an e-mail to datenschutz@elobau.de or by sending a message to the contact information provided in the imprint.

(5) Please note that we evaluate your user behavior when sending the newsletter. To evaluate user behavior, the sent e-mails contain so-called web beacons or tracking pixels that represent one-pixel image files. The data are collected exclusively pseudonymised, i.e., the IDs are not linked to your other personal data. This means the data cannot be directly linked to an individual person. The data are collected in order to optimise the content and the shipping date. Such tracking is also not possible if you have deactivated the display of images in your e-mail program by default. In this case, the newsletter will not be displayed fully and you may not be able to use all functions. If you choose to display the images manually, the above tracking takes place.

§ 7 Use of our Application Portal

  • We operate an application portal which is based on the persis system (https://www.persis.de). In order to submit your application data, you must first agree to the data protection regulations through an opt-in procedure. In the portal itself, you are asked to enter the following personal data as mandatory fields:

    title, first name, last name, street name, house number, ZIP code, city and country, telephone number and e-mail address for contact.

    To process your application, you will be asked to upload a CV. This is the minimum requirement for processing your application. All other data are voluntary information.

  • The legal basis is Art. 6 (1) para. 1 letter (a) GDPR and your consent to the Terms of Use.

  • Recipients or categories of recipients of personal data: human resources department and supervisor of the position to which you have applied, management. The data are not disclosed to third parties, with the exception of our service providers in the context of order processing.

  • As an applicant, you will receive information in accordance with Art. 13 GDPR on the use of your data during the application process.


§ 8 Use of Google Analytics

(1) This website uses Google Analytics, a web analytics service provided by Google Inc. ("Google"). Google Analytics uses so-called "cookies", text files that are stored on your computer and which allow an analysis of the use of the website by you. The information generated by the cookie about your use of this website is usually transmitted to a Google server in the USA and stored there. However, if IP anonymisation is enabled on this site, Google will truncate your IP address beforehand within member states of the European Union or other parties to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be sent to a Google server in the US and shortened there. On behalf of the operator of this website, Google will use this information to evaluate your use of the website, to compile reports on website activity and to provide other services related to website activity and Internet usage to the website operator.

(2) The IP address provided by your browser as part of Google Analytics will not be merged with other Google data.

(3) You can prevent the storage of cookies via a corresponding setting of your browser software. (4) This website uses Google Analytics with the extension “_anonymizeIp()”. This allows for IP addresses to be processed truncated, which means they cannot be associated with any individual person. As far as the data collected about you is personal, it will be excluded immediately and the personal data will be deleted immediately.

(5) We use Google Analytics to analyze and regularly improve the use of our website. The collected statistics allow us to improve our offering and make it more interesting to you as a user. (7) This website also uses Google Analytics for analyzing visitor flows across devices, which is implemented by means of a user ID. You can disable cross-device analysis of your usage in your account under “My Data”, “Personal Information”.

§ 9 Use of eTracker

(1) This website uses technologies from eTracker GmbH (http://www.etracker.com) to collect and store data for marketing and optimisation purposes. From this data, usage profiles can be created under a pseudonym. Cookies may be used for this purpose. Cookies are small text files that are stored locally in the cache of the site visitor's Internet browser. Cookies enable recognition of the Internet browser. The data collected with the eTracker technologies will not be used to personally identify the visitor to this website without separately granted consent of the person concerned and will not be combined with personal data about the bearer of the pseudonym. The collection and storage of data can be objected to at any time with future effect.
Please exclude me from the eTracker count.

§ 10 Use of Social Media Plugins

(1) We are currently using the following social media plug-ins: Facebook, Google+, Twitter, Xing, LinkedIn. We use a so-called two-click solution. This means that when you visit our site, no personal data is initially passed on to the providers of the plug-ins. The provider of the plug-in is identified by the marking on the container above its initial letter or the logo. We allow you to communicate directly with the provider of the plug-in via the button. The plug-in provider does not receive information that you have accessed the corresponding website of our online offer unless you click on the marked field and thereby activate the plug-in. Furthermore, the data mentioned under § 3 of this declaration are transmitted. In the case of Facebook and Xing, the IP address is anonymised immediately after collection, according to the respective provider in Germany. By enabling the plug-in, personal data is transferred from you to the respective plug-in provider and stored there (for US providers in the USA). Since the plug-in provider collects data mainly via cookies, we recommend that you delete all cookies before clicking on the grayed-out box by adjusting your browser's security settings.

(2) We have no influence on the data collected and data processing procedures, nor do we know the full extent of data collection, the purposes of processing or the storage periods. We also have no information on the deletion of the data collected by the plug-in provider.

(3) The provider stores the data collected about you in usage profiles and uses it for advertising, market research and/or to tailor its website to you. This type of data evaluation is primarily intended for the purpose of providing targeted advertising (also for users who are not logged in), and to inform other users of the social network about your activities on our website. You have the right to object to the creation of such user profiles. Please contact the respective plug-in provider if you intend to do so. The plug-ins we offer allow you to interact with social networks and other users, so that we can improve our offer and make it more interesting for you. (4) The data is transferred regardless of whether you have an account with the plug-in provider and are logged in there. If you are logged in with the plug-in provider, your data collected with us will be directly assigned to your existing account with the plug-in provider. If you click the activated button and, for example, link the page, the plug-in provider also stores this information in your user account and shares it publicly with your contacts. We recommend that you log out regularly after using a social network, especially before enabling the button, as this way you can prevent the plug-in provider from associating the data to your profile.

§ 11 Integration of YouTube videos

(1) We have integrated YouTube videos on our website, which are stored on http://www.YouTube.com and can be played directly from our website. These are part of the "extended data privacy mode", i.e. no data about you as a user is transmitted to YouTube if you do not play the videos. The data referred to in paragraph 2 is only transmitted when you play the videos. We have no influence over this data transfer.

(2) By visiting the website, YouTube is informed about your visit to the relevant subpage of our site. Furthermore, the data mentioned under § 3 of this declaration are transmitted. § 13 Use of Google Adwords Conversion

(1) We use Google Adwords to draw attention to our offers with the help of advertising material (so-called Google Adwords) on external websites. The data we obtain through advertising campaigns allow us to assess how successful the individual advertising measures are. Our objective is to show you advertisements that are of interest to you, to make our website more engaging for you and to obtain a fair calculation of advertising costs.

(2) These advertising media are delivered by Google via so-called "Ad Servers". For this purpose, we use ad server cookies, through which certain parameters for measuring success, such as the insertion of ads or clicks by users, can be measured. If you access our website via a Google ad, Google Adwords stores a cookie on your PC. These cookies usually expire after 30 days and are not intended to identify you personally. The unique cookie ID, number of ad impressions per placement (frequency), last impression (relevant for post-view conversions) and opt-out information (identifier that the user no longer wishes to be addressed) are usually stored as analysis values for this particular cookie.

(3) These cookies enable Google to recognise your Internet browser. If a user visits certain pages of an Adwords customer's website and the cookie stored on their computer has not expired, Google and the customer can see that the user has clicked on the ad and has been redirected to this page. Each Adwords customer is assigned a unique cookie. This means that cookies cannot be traced via the websites of Adwords customers. We do not collect or process any personal data through the aforementioned advertising measures. Google only provides us with statistical evaluations. On the basis of these evaluations, we can identify which of the used advertising measures are particularly effective. We do not receive any further data from the use of advertising material; in particular, we cannot identify users on the basis of this information.

(4) Due to the marketing tools used, your browser automatically establishes a direct connection to the Google server. We have no influence on the scope and further use of the data which are collected by Google through this tool and thus inform you to the best of our knowledge: by integrating AdWords Conversion, Google receives information that you have accessed the relevant page on our website or clicked an ad from us. If you are registered with a Google service, Google may associate your visit with your account. Even if you are not registered with Google or have not logged in, it is possible that the provider may obtain and store your IP address.

(5) You can prevent participating in this tracking process in various ways: a) by setting your browser software accordingly, in particular by suppressing third-party cookies, you will not receive any ads from third-party providers; b) by disabling the cookies for conversion tracking by setting your browser to block cookies from the "www.googleadservices.com" domain, https://www.google.de/settings/ads; please note that this setting is deleted if you delete your cookies; c) by disabling interest-based ads from providers that are part of the "About Ads" self-regulation campaign via the link http://www.aboutads.info/choices; please note that this setting is deleted if you delete your cookies; d) by permanent deactivation in your browser software Firefox, Internet Explorer or Google Chrome under the link http://www.google.com/settings/ads/plugin. (1) The website also uses the remarketing function "Custom Audiences" of Facebook Inc. "("Facebook").
